Short-Term Holiday Let Agreement

Property: Studio on Albert Street, Durham City, DH1

Rental Amount: Variable, based on length of stay
Security Deposit: £250

1. Nature of Agreement

This is a short-term holiday letting agreement. It does not create a tenancy or any rights of occupation beyond the dates agreed. The Guest agrees that the Property is let strictly for holiday purposes only, in accordance with Section 9(1) of the Housing Act 1988.

2. Booking & Payment

  • Full payment is due at the time of booking.
  • A booking is confirmed once the Guest has accepted these terms and the Host has received payment.
  • A security deposit of £250 (via card pre-authorisation) is held from 1 day before arrival and voided 3 days after departure.

3. Cancellation Policy

  • Flexible: 60% of paid prepayments are refundable if the booking is cancelled 30 days or more before arrival.
  • No refunds are issued for cancellations made within 30 days of arrival.
  • Cancellations must be made in writing (email is sufficient).

4. Check-in / Check-out

  • Check-in: From 2:00 PM
  • Check-out: By 10:00 AM
  • Late check-out will incur an additional charge of £50 per hour unless agreed in advance.

5. Guest Responsibilities

The Guest agrees to:

  • Treat the property and its contents with care and respect.
  • Keep the property clean and leave it in the condition it was found.
  • Report any damage or loss immediately.
  • Not smoke inside the property.
  • Not bring pets into the property.
  • Not exceed the agreed number of occupants (max: 2 adults, 1 infant).
  • Not host parties or events.
  • Observe quiet hours from 10:00 PM to 8:00 AM.
  • Provide valid government-issued photo ID if requested.
  • Ensure all adult occupants are 18 years or older unless accompanied by a responsible adult.
  • Ensure any booking made on behalf of others is disclosed in advance; the lead booker remains responsible for all guests.
  • Not use the property for commercial purposes, unlawful activity, or assign or sublet it to any other person.

6. Host Responsibilities

The Host agrees to:

  • Provide the property in a clean and good state of repair.
  • Ensure gas safety and electrical compliance.
  • Maintain adequate buildings and contents insurance.
  • Respect the Guest’s privacy.

7. Damages, Deposit & Inventory

  • The Guest is liable for any damage caused to the property or its contents during the stay.
  • The Host may deduct reasonable amounts from the deposit or pursue additional compensation where necessary.
  • A photographic inventory is retained. Discrepancies may result in deductions from the deposit.

8. Cleaning Policy

  • Guests are expected to leave the property in a reasonable condition.
  • Excessive cleaning beyond standard usage will result in deductions from the deposit, with a minimum additional charge of £50.
  • A standard cleaning fee is included in the rental price.

9. Force Majeure

Neither party shall be liable for delay or failure to perform obligations under this Agreement due to circumstances beyond their reasonable control, including but not limited to natural disasters, government restrictions, or public health emergencies.

10. Data Protection (GDPR)

Personal data collected as part of this booking will be processed in accordance with UK GDPR. Data will not be shared with third parties unless legally required.

11. Right of Termination

The Host reserves the right to terminate the stay without refund if the Guest breaches the terms, behaves inappropriately, or causes serious nuisance.

12. Host Cancellation Policy

The Host reserves the right to cancel the booking in the event of:

  • Emergency maintenance or damage rendering the property uninhabitable.
  • Double-booking caused by technical or administrative error.
  • Force majeure events (see Clause 9).
  • Circumstances which make it unsafe or unlawful to accommodate guests.

In such cases, the Guest will receive a full refund of all monies paid. The Host will make reasonable efforts to assist in locating suitable alternative accommodation but shall not be liable for additional costs incurred.

13. Limitation of Liability

The Host shall not be held liable for accidents, injuries, loss, or damage incurred by the Guest or their belongings during the stay, except where caused by the Host’s negligence.

14. Governing Law

This Agreement is governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

15. Guest Consent

By confirming the booking and making payment, the Guest confirms that they have read, understood, and agreed to the terms of this Agreement.
